OFFICIAL RULES OF THE PROMOTIONAL CAMPAIGN
“GRIZZLY MONTAGE sets you up for EURO 2020”
Period: June 24, 2021 – July 14, 2021
SECTION 1. CAMPAIGN ORGANIZER
1.1 The Campaign Organizer ” GRIZZLY MONTAGE mounts you for EURO 2020” is TEMAD CO SRL, a Romanian legal entity, with headquarters in the municipality of Braşov, Şoseau Cristianului no . 12, Postal Code 500053, registered at the Braşov Trade Register under no. J/08/2951/1994, CUI RO 6620400, bank account RO77 INGB 0009 0082 0536 8918 opened at ING Brașov, having a subscribed and fully paid-up share capital of 1,000,000 lei, having Personal Data Operator number 22953 of 26.04.2012 (named hereinafter “Organizer”).
The campaign runs during: June 24, 2021 – July 12, 2021.
SECTION 2. RIGHT TO PARTICIPATE
2.1. The Campaign is organized and carried out on Facebook in accordance with the provisions of this Regulation and is accessible to any natural person who is at least 18 years old, on the date of the start of the Campaign, domiciled in Romania, who has a Facebook account. 2.2. Persons under the age of 18 are not entitled to participate in the Campaign. Age verification will be done at the time of validation. The winner assumes responsibility for all information they provide to the Organizer.2.3. Employees of TEMAD CO SRL, as well as spouses and first-degree relatives (parents, children) of employees of the aforementioned company cannot participate in the Campaign.
2.4. Participation in this Campaign implies full, express and unequivocal knowledge and acceptance of these Regulations. 2.5. The Organizer reserves the right to cancel the registration of any Participant who does not comply with the Regulations.SECTION 3. CAMPAIGN MECHANISM
3.1. The campaign takes place online only, on the «TEMAD Romania» Facebook page available at https://www.facebook.com/TEMAD .Romania/.3.2. Any other registration made by other means will not be considered.
3.3. The campaign includes 9 short-term contests, hereinafter referred to as “lightning contest” with reference to the football matches from the European Football Championship 2020, hereinafter called Euro 2020. 3.4. An entrant can enter one flash contest with only one comment, but can participate in all 9 flash contests. 3.4. For each contest, a post will be made on the Facebook page «TEMAD Romania» – https://www.facebook.com /TEMAD.Romania/ with reference to a match being played at Euro 2020. 3.5. Registration is done by publishing a text-type comment on the lightning contest post, which contains a prediction regarding the name of the winning team in the match to which the contest post refers. Comments will be added until the start time of the match.3.6. In order for a registration to be valid in order to participate in the Campaign, the cumulative fulfillment of the following conditions is necessary:
- The participant must have the right to participate according to the provisions of Section 2;
- The participant must be a fan of the «TEMAD Romania» page (appreciated with Like);
- Participant has distributed the contest post (Share)on his personal page publicly;
- The participant responded with a comment according to point 3.5.
- not to violate any of the Rules applicable to the use of the «TEMAD Romania» Facebook page https://www.facebook.com/TEMAD .Romania/.
- not to violate these Official Regulations in any way; not contain any illegal, immoral or anti-social message;
- not contain defamatory details, words or symbols that are generally or directly offensive to people of a particular race, entity, religion, sexual orientation or socio-economic group;
- not contain threats to any third person, place, business or group, not violate the privacy, right to privacy and/or other rights of any third person, company or entity and must not otherwise violate any laws and applicable regulations;
- not contain references or messages regarding registered or unregistered trademarks;
- not to use expressions protected by copyright or other intellectual property rights;
- not to promote cigarette or alcohol brands, or the consumption of tobacco and alcohol;
- not to contain messages addressed to minors and not to refer to minors;
- to respect the theme of the Campaign as described on the website and in the content of the Campaign post;
- not to include personal data belonging to other people.
The participant who will post a comment that does not meet the conditions listed in letter a – j, above, will be disqualified, and will not be considered for inclusion in the draw and/or and designation of the winning Participant. The organizer has the right, but not the obligation, to delete/modify/alter in any way the comment(s) of the Participant/Participants that do not meet the conditions listed in letter a – j, above.
3.5. The Organizer is not responsible for the fact that third parties may use the materials that the Campaign participants register or make available in the spaces dedicated to the Campaign. Participants also assume full civil and criminal liability for the materials they publish. Any entry based on a text/photo/video that does not meet the entry criteria will be invalidated, and the participant will not be considered entered in the Campaign. 3.6. To participate in this Campaign, a Participant must simultaneously meet all the above conditions. Participants who do not meet the registration and participation conditions mentioned in the Regulations will be removed from the Campaign by the Organizer. 3.7. The organizer reserves the right to remove from the Campaign or cancel the decision by which a participant is designated as a winner, in the conditions where the said winner is suspected of defrauding the Campaign or in the case of users who have registered in the Campaign based on accounts created by on temporary, provisional addresses that expire automatically after a certain period of time or accounts that do not belong to them.SECTION 4. SECTION 5. DESIGNATION OF WINNERS. AWARD OF PRIZES
5.1. The grand prize of the Campaign will be drawn by electronic draw from all valid entries from all contest posts, by the Organizer’s representatives, on July 14, 2021. 5.2. The electronic draw sessions will take place on the first working day after the day of each match participating in the campaign. 5.3. The chosen winners will be announced by posting on the Facebook page of “TEMAD Romania” on the day of the draw.5.4 After the announcement of the Winner, he must send within a maximum of 3 working days via a private message, on the Facebook page «TEMAD Romania» https://www.facebook.com/TEMAD.Romania/ personal data including name, surname, phone number, date of birth, email address, mailing address. The grand prize winner must also send a copy of their ID to pay the fees and taxes for the prize.
5.5. By participating in this Campaign, the Winners expressly grant the Organizer the right to use their data for advertising purposes and for the promotion of this Campaign. 5.6. The sending of the prizes to the Participants designated as winners will be carried out within a maximum of 30 working days from the final validation of the winners. The organizer will not be held responsible if the data provided by the Participants designated as winners for the transmission of the prizes, are not correct. 5.7. The organizer reserves the right to request a copy of the winner’s identity document before awarding the prize. Any false declaration regarding the identity leads to the immediate invalidation of the participant. 5.8. Prizes will be sent to the Winners by Courier Rapid. 5.7. The prizes of the winners will be sent only to addresses on the territory of Romania.SECTION 6. LIMITATION OF LIABILITY
6.1. The organizer is entitled to take all necessary measures in case of an attempt to defraud the system, abuse or any other attempts that could affect its image or the costs of this Campaign. 6.2. In the event of a dispute over the validation of a Campaign entry or a winner, the Organizer’s decision, based on these Regulations, is final. 6.3. The organizer does not assume responsibility for:- Errors in the data provided by the winners; the accuracy of the contact data is not the responsibility of the Organizer, being the sole responsibility of the participants. As such, the Organizer has no obligation in the event that participants provide erroneous data that led to the impossibility of remitting the prize or the impossibility of identifying a winner;
- Impossibility of a winner to take possession of the prize;
- Delays in the delivery/handover of prizes caused by delays in the provision of postal/courier services, etc.
- Any malfunction of the Internet network that prevents the proper functioning of the Campaign;
- Damage of any reception equipment or communication lines;
- Risks of virus contamination, computer error, technical failure;
- Loss of any data
- Technical performance, response times, information transfer, risks of internet connection interruption.
- Any technical, hardware or software failure of any kind that prevented or limited your ability to participate in the Campaign.
- Errors of a technical nature.
SECTION 7. DISPUTES
7.1. In case of disputes arising between the Organizer and the Campaign Participants, they will be settled amicably. If it is not possible to resolve disputes amicably, the parties involved in the dispute will submit the dispute for resolution to the competent Romanian courts. 7.2. Any complaints related to the running of the Campaign can be sent to the following address: TEMAD CO S.R.L., with headquarters in Brașov, Șoseaua Cristianului no. 12, within a maximum of 2 (two) days from the date of publication of the winner/winners who are considered injured in some kind. After this date, the Organizer will no longer consider any appeal. 7.3. The organizer is entitled to take all necessary measures in case of attempted fraud of this Campaign, the system, abuse or any other attempts that could affect the image or costs of this Campaign. 7.4. In the event that persons who influenced or facilitated the winning of prizes are identified, the Organizer has the right to demand that those persons be prosecuted in court, based on the existing evidence.SECTION 8. FORCE MAJEURE
8.1. For the purposes of these Regulations, force majeure means any event that cannot be controlled, remedied or foreseen by the Organizer, including the inability of the Organizer for reasons beyond its control and the occurrence of which renders the latter unable to fulfill its assumed obligations by Regulation. 8.2. If a situation of force majeure prevents or delays in whole or in part the execution of the Regulation and the continuation of the Campaign, the Organizer will be exempted from liability for the fulfillment of its obligations for the period in which this fulfillment will be prevented or delayed, according to the Civil Code. The organizer, if he invokes force majeure, is obliged to notify the Campaign Participants of its existence within 5 (five) working days from the occurrence of the case of force majeure.SECTION 9. PERSONAL DATA PROCESSING
9.1 All natural persons, legal representatives of the legal entity, who participate in the Campaign are guaranteed their rights in accordance with Law no. 677/2001 (for the protection of individuals with regard to the processing of personal data and the free movement of such data), among which we mention: the right to information (art. 12), the right to access data (art. 13), the right to intervene on the data (art. 14), the right of opposition (art. 15), the right not to be subject to an individual decision (art. 17) and the right to go to court (art. 18).
9.2. By registering for the Campaign, the Participants express their agreement regarding the provision and processing of their personal data to/by the Organizer, for the purpose of including this personal data in the Organizer’s database.9.3 The purposes of establishing the database are: registering for the Campaign, identifying and naming the winners of this Campaign, awarding the prizes, making statistical reports on the customers, products and services of the Organizer, informing them, through various means of communication (mail, e-mail, telephone, SMS or any other means of communication) regarding this Campaign or other actions carried out in the future.
9.4 Each natural person who participates in the Campaign agrees to the use of his personal data by the Organizer for marketing purposes and has the right to request exclusion from the Organizer’s database, by sending a written request to the Organizer at the following address Braşov, Cristianului Road no. 12, postal code 500053.
9.5 At the request of the participants, addressed in writing to the Organizer, the latter undertakes:
-
- to confirm to the applicant whether or not it processes his personal data, free of charge, for one request per year;
- to rectify, update, block, delete or transform into anonymous data, free of charge, the data whose processing does not comply with the provisions of Law no. 677/2001;
- stop processing the applicant’s personal data free of charge.
9.6 The organizer processes personal data in accordance with Law no. 677/2001, as a personal data operator, under notification no. 22953 sent to the National Authority for the Supervision of Personal Data Processing. The personal data collected during this Campaign will not be disclosed to third parties, except in cases where the Organizer must comply with the obligations imposed by the legislation in force.
SECTION 10 – FEES AND RELATED TAXES
10.1 The Organizer is not responsible for the payment of fees, taxes or other fiscal obligations related to the prizes offered, with the exception of the withholding tax applicable to individual income from promotional campaigns, which the Organizer is obliged to calculate, to retain it and transfer it to the state budget according to the provisions of Law no. 571/2003 regarding the Fiscal Code.
10.2 The organizer is not responsible for the payment of taxes or other financial obligations related to the use of prizes, these being the exclusive responsibility of the winner. From the date of delivery of the prizes, all legal or usage expenses related to them shall be borne by the owner.
10.3 This Campaign is carried out for marketing purposes.
SECTION 11. OTHER PROVISIONS OF THE REGULATION
11.1 By participating in this Campaign, the participants agree and unconditionally and irrevocably accept the provisions of these Regulations. If the Organizer finds that the conditions stipulated by these Regulations have not been fulfilled and/or not respected, it reserves the right to suspend the rights and benefits of the winner at any time, without any other compensation or payments.
11.2 The organizer reserves the unilateral right to modify the Regulation, and these modifications will enter into force after its publication on the Facebook page https://www.facebook.com/TEMAD.Romania/. This Regulation was concluded and signed today, June 24, 2021 in Braşov.
The promotional campaign respects the GDPR regulation and is consistent with it, without exception.
